The terms and conditions, privacy policy, and community guidelines governing the use of these services form a legally binding agreement between Brokery.in and the User (the “Agreement”).
Brokery.in and/or any other linked website(s) provide an online information and communications service to you, contingent upon your adherence to the terms and conditions outlined below.
IEIL reserves the right to amend or modify these terms and conditions at any time, with such modifications taking effect immediately upon their posting on Brokery.in. You are encouraged to periodically review the modified terms and conditions to remain informed of any changes, as your continued access to or use of Brokery.in will be considered conclusive evidence of your acceptance of these terms and conditions, as amended or modified from time to time. Additionally, IEIL may suspend the operation of Brokery.in for support or technical upgrades, maintenance work, content updates, or for any other reason deemed necessary.
Should you use Brokery.in in a manner that is inconsistent with these terms and conditions, IEIL reserves the right to terminate your access, block your future access, and/or pursue any additional remedies deemed appropriate based on the circumstances of your misuse.

Definitions
The term Subscriber/User encompasses any individual or legal entity that has subscribed to the Services of Brokery.in, whether on a paid or complimentary basis, and who is granted access to Brokery.in through the use of a sign-in username and password. The username and password may be assigned by Brokery.in or selected by the Subscriber, or mutually agreed upon with Brokery.in. It is explicitly stated that only the authorized User is permitted to access the Services provided by Brokery.in.
The term Browser/Visitor refers to any individual who utilizes the Services offered by Brokery.in without the necessity of creating an account, meaning they can access non-restricted areas of Brokery.in. The term Advertiser includes a Subscriber/User who uploads or shares content using the Services.
Access to and use of Brokery.in is governed by these terms and conditions as well as community guidelines. For the purposes of this Agreement, any individual who lacks a legal or contractual right to access the Services but does so will be classified as an ‘unauthorized user’ and will still be bound by the terms and conditions that regulate the use of Brokery.in, particularly in relation to respecting the intellectual property rights of IEIL and adhering to the terms and conditions outlined below.
The terms ‘User’ and ‘Customer’ encompass both the Subscriber/Advertiser(s) and Browser/Visitor(s).
The terms ‘Service’ or ‘Services’ refer to the interactive online information service provided by Brokery.in on the internet, through which users can access information stored in the database maintained by Brokery.in. This definition also includes the search tools that allow Users to explore the hosted databases and information using various search tools that align with their search criteria. Additionally, the term encompasses services related to the space utilized by customers for advertisements, such as listings and banners. Users can then select one or more items presented to view the complete document or record. It is important to note that the term Service does not imply that Brokery.in acts as an agent, either explicitly or implicitly, on behalf of any User/Customer; rather, it serves solely as a medium for information exchange.
The term RERDA refers to the Real Estate (Regulation and Development) Act, 2016 (http://mhupa.gov.in/User_Panel/UserView.aspx?TypeID=1535), including any amendments and associated rules or regulations that may be established under it.
Submission and administration of listings/advertisements.
The User consents to refrain from submitting any property descriptions, photographs, financial details, contact information, or any other data related to each property to Brokery.in unless the User who is submitting such a Listing/Advertisement has obtained and received all necessary rights and authorizations from the property owner or the holder of the power of attorney, including permissions from the photographer and/or copyright owner of any photographs, to publish and promote the aforementioned Property(s) on the User’s website or on Brokery.in. Likewise, Brokery.in does not assume any ownership, either directly or indirectly, towards any individual whatsoever, concerning banners displayed on its website by its clients, which are strictly categorized as the sale of advertising space by Brokery.in, and it has not conducted any independent verification regarding the authenticity or compliance requirements, as may be mandated under any applicable law, of such images/banners/listings. Certain listings may include third-party audio/video content (“AV Content”) provided solely for general informational purposes, and such content does not represent a recommendation or solicitation nor is it intended to influence any type of purchase or decision. Brokery.in and the providers of the AV content make no guarantees regarding its accuracy or completeness. The User consents to the use of any content or information provided to IEIL/Brokery.in for promotional, marketing, and publicity purposes without any form of compensation. When you provide us with voice samples or voice recordings for the purpose of generating voiceovers for video listings, you grant us a royalty-free, irrevocable, worldwide, sublicensable, and transferable right and license to utilize, modify, and further develop the voice samples and voice recordings in a manner that Brokery.in considers appropriate. In the event that a User is subject to the RERDA, it must secure all necessary approvals, licenses, and permits issued by the relevant authorities concerning the Project/Land/Apartment/Plot in the listing, by adhering to the due process of law. RERDA and all properties submitted, including their current status and nature, must also indicate whether the property is free from any encumbrances. Additionally, the User is required to provide a brief background regarding the title, ownership, and possession of the property. IEIL may request the User to substantiate their claims regarding the property’s status with documents that it may specify from time to time. Furthermore, the User may be asked to validate their claims concerning the nature and status of the property by swearing an affidavit that confirms the authenticity of the information or data provided or displayed. IEIL reserves the right, at its sole discretion and without any obligation, to search for and remove properties that are claimed to have been submitted in violation of this provision. Moreover, IEIL may demand further evidence of compliance with this provision from Users who are accused of submitting properties or other information or data in breach of these terms and conditions. IEIL retains the right, at its sole discretion, to terminate the accounts of and deny Service to any User who repeatedly or intentionally contravenes these terms and conditions. Additionally, the User consents to allow the Property listing, or any part thereof, to be searched, displayed, accessed, downloaded, copied, and otherwise referenced by users of both the User’s website and the Brokery.in website. IEIL shall have the exclusive authority to determine how any Property will be searchable, displayed, accessed, downloaded, copied, and otherwise utilized on Brokery.in, and it reserves the right to modify the property listing in the exercise of its rights under these terms and conditions. In addition to the aforementioned terms, the User agrees (a) to represent and warrant that all Properties and associated information provided by the User will be accurate;
(b) The User shall not allow the posting of a property on Brokery.in under any name other than that of a real estate agent who has been properly authorized and engaged by the property owner for this purpose;
IEIL will place property-related information in designated sections of Brokery.in or on other mirror or parallel site(s). IEIL retains the right, in accordance with reasonable commercial business practices, to remove all or any portion of the Properties listed on the User’s website or on Brokery.in without prior notice. IEIL does not accept any responsibility for verifying the accuracy of reports or data files submitted by the User. While IEIL will make all reasonable efforts for data backup and business continuity, the User is solely responsible for maintaining backup copies of all information, photographs, and other materials provided to Brokery.in.
Users who are purchasing or renting property/properties through Brokery.in must independently verify the details of the property/properties, including rights, title, ownership, liens, etc. The ‘verified’ tag displayed on property/properties on Brokery.in only signifies the verification of the existence of the property as advertised. At no time should the ‘verified’ tag be interpreted as a verification of any documentation, ownership details, area, or pricing information of the property/properties.
